NY DOL will not take a claim for wages owed more than 3 years before you file. File the LS 223 form as soon as you notice the shortfall so the clock doesn't run out on part of what you're owed.

You fill out the Labor Standards Complaint Form, LS 223, checking the sections that match your situation: unpaid wages, minimum wage or overtime, sick leave, or wage supplements like promised vacation pay. Submit it online through the DOL's upload link or mail it to the Division of Labor Standards in Albany, and once it's accepted you get a case number and an investigator who contacts your employer, sometimes visiting the workplace or holding a compliance conference. If DOL finds violations, it can order your employer to pay you and fix the underlying practice.
